Terms of Service – SMS Communications

These Terms of Service ("Agreement") outline the terms under which you agree to receive text messages (SMS/MMS) from James T. Maloney, Attorney at Law (“we,” “our,” “us”). By providing your mobile number and opting in to receive messages, you agree to these terms.
1. Service Description
We may send you text messages related to:
- Appointment reminders
- Case updates
- Legal service notifications
- Document requests
- Billing alerts
- General administrative and client service communications
These messages are intended to enhance the service we provide to you and maintain clear, timely communication regarding your legal matter.
2. Consent to Receive SMS
By opting in to receive SMS communications, you:
- Confirm that you are the authorized user of the mobile phone number provided.
- Authorize the Law Office of James T. Maloney to send SMS messages to the number you provided.
- Consent to the use of an automated system for delivering text messages.
Your consent is not required as a condition of hiring legal services, and you may continue to work with our firm if you choose not to receive SMS messages.
3. Message Frequency
Message frequency will vary based on your case, interaction with our office, and service needs. On average, you may receive 1–5 messages per week during active service periods.
4. Fees & Charges
Message and data rates may apply depending on your mobile carrier plan. We are not responsible for any charges billed to you by your mobile service provider.
5. Opting Out
You may opt out of SMS communications at any time by replying:
- STOP – to unsubscribe from all future messages
- HELP – to get customer service contact info
After opting out, you may receive one final message confirming your choice. You may rejoin by providing consent again.

6. Data Collection & Use
We may collect and store the following information:
- Your mobile number
- The date, time, and content of your messages
- Delivery and response logs
We use this data only to provide and improve our SMS services, comply with legal obligations, and maintain service records.
We will never sell or share your information with third parties for marketing purposes.
We may use third-party providers (e.g., SMS platforms) to deliver messages. These vendors are required to safeguard your information and comply with applicable laws.
7. Security of Communications
Text messaging is not a fully secure method of communication. While we take reasonable measures to protect your data, we cannot guarantee the confidentiality of information transmitted via SMS. Please use discretion when sending sensitive legal information.
8. Termination of Service
We reserve the right to suspend or terminate SMS communications at any time, without prior notice, including in cases of misuse, spam complaints, or noncompliance with these terms.
9. Age Restrictions
Our SMS services are intended only for individuals 18 years or older. By opting in, you confirm you meet this age requirement.
10. Modifications to Terms
We may update these Terms of Service at any time. When we do, we’ll revise the “Last Updated” date at the top of this page. Continued use of our SMS services constitutes acceptance of any updated terms.
